Acceptance of Terms

These Terms of Service ("Terms") constitute a legal agreement between you and DATA PROS, LLC. By connecting to, accessing, or playing our games and/or installing our application, you acknowledge that you have read, understood, accepted, and agree to be bound by these Terms. If you do not agree to these Terms, please do not install, connect to, access, or use the game application or any games offered therein.

Please note that if you play our games on our publisher's website, you must first comply with the terms of use of the publisher with whom you are interacting. Their privacy policy and terms of use, not ours, will apply to any such interaction.

The Games are intended solely for use by individuals who: (a) are at least thirteen (13) years old; and (b) have the legal capacity to enter into these Terms and enter into binding agreements under any applicable law, or have obtained the consent of their legal guardian to enter into these Terms. Therefore, you hereby represent that you have the legal authority to enter into these Terms and enter into binding agreements under any applicable law, and are entitled to use the Games in accordance with these Terms and fully perform your obligations hereunder. If you are between 13 and 18 years of age, you represent that your legal guardian has reviewed and agreed to these Terms. Even with the explicit consent of a legal guardian, individuals under a specific age may still be prohibited from participating due to the age restrictions of particular games.

Amendments to Terms

The Company reserves the right to modify, delete, add, amend, extend, or otherwise change these Terms at any time. Your continued use of the Games constitutes acceptance of such changes. If you do not agree to these Terms, you are not entitled to access and/or obtain information or otherwise continue to use the Games. Therefore, you are responsible for periodically reviewing these Terms to be aware of any changes. The most current version of the Terms shall always prevail and supersede any other versions.

User Content

As part of video chats or other means, users may display various content through specific Games. All content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such content. We may monitor or control content published through the Games, and we assume no responsibility for such content. You use or rely on any content or materials published through or obtained via the Games at your own risk.

"Content" means text, graphics, images, data, messages, posts, photos, music, software, audio, video, works of any kind, chat logs, and information or other materials published, generated, provided, or otherwise made available through the Games, including but not limited to your name, profile picture, voice, likeness, game records, and user content; and (ii) "User Content" means any content that you provide, import, or make available through the Games.

We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications published via the Games, nor do we endorse any opinions expressed via the Games. You understand that by using the video features available in certain Games, you may be exposed to Content that might be offensive, harmful, inaccurate, or otherwise inappropriate, or in some cases, to posts that have been mislabeled or are otherwise deceptive. Under no circumstances will DATA PROS, LLC be liable in any way for any Content, including but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted, or otherwise made available via the Games, or disseminated elsewhere.

You retain all your rights to any User Content you submit, post, or display on or through the Games. By submitting, posting, or displaying User Content on or through the Games, you grant us a worldwide, unrestricted, unconditional, perpetual, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Content in any media or distribution method. Notwithstanding the foregoing and any other provision in these Terms, we will only use your video chat session content to allow you to connect with other players and for no other purpose.

In addition to the above, we may improve, translate, reformat, archive, store, or otherwise exploit your User Content and all modifications and derivative works thereof in any manner, including creating derivative works, commercializing, publishing, distributing, disclosing, selling, reselling, licensing, sublicensing, assigning, renting, leasing, transmitting, publicly displaying, publicly performing, or making available access electronically, broadcasting, communicating to the public via telecommunications, showing, performing, entering into computer memory, and using and practicing the same in any way, on any media, at any time, including for advertising, marketing, and promotional purposes. You are not entitled to any attribution, approval, or compensation for any such use of the User Content you submit. To the extent permitted by applicable law, you hereby waive any moral rights you may have in any User Content. The license you grant us to use User Content will terminate when you delete your User Content or close your account, unless your User Content has been shared with others and they have not deleted it. However, you understand and accept that deleted Content may persist in backup copies for a reasonable period of time.

License

Subject to your agreement and compliance with these Terms, DATA PROS, LLC grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited license to use the Games. Your use of the Games is solely for your personal, non-commercial entertainment purposes and for no other purposes. You hereby acknowledge that this license to use the Games is subject to these Terms, the Game Rules, and applicable laws. If you violate these Terms or do not agree to any provision of these Terms at any time, your license to use the Games will be immediately revoked, and you must immediately cease using the Games. If the Games, or any part thereof, is determined to be prohibited by the laws of your country, this license will be automatically revoked.

These Terms do not grant you any interest in the Company's intellectual property, but only grant you a limited, revocable right to use the Games in accordance with these Terms. Nothing in these Terms constitutes a waiver of the Company's intellectual property rights under any law.

Usage Restrictions

Certain behaviors are strictly prohibited when using the Games. Please read the following restrictions carefully. Violation of any provision in these Terms gives DATA PROS, LLC the right, in its sole discretion, to terminate your access to the Games and/or hold you civilly and/or criminally liable.

You must not:

Create an account or access the Games if you are under 13 years of age.

Use the Games illegally or encourage or promote any illegal activity.

When playing the Games and using any media features within the Games, upload, post, display, transmit, or otherwise disseminate any User Content that:

(a) Is indecent, explicit, obscene, pornographic, or otherwise offensive or objectionable.

(b) Contains defamatory, libelous, threatening, harassing, abusive, spam, inflammatory, or racist material, promotes discrimination, hatred, or harm against any individual or group, or constitutes a direct and specific threat of violence to others.

(c) Is illegal, contrary to public policy, or could lead to a violation of any applicable law, regulation, or government policy.

(d) Is defamatory or libelous.

(e) Infringes the intellectual property rights or other rights of any third party.

(f) Infringes the privacy rights, publicity rights, moral rights, or any other rights of any third party, including interfering with or infringing users' privacy and other rights, impersonating other users in a way that misleads, confuses, or deceives others, or collecting, publishing, soliciting, or obtaining users' personally identifiable information without the user's explicit consent, whether manually or using any robot, crawler, any search or retrieval application, or using other manual or automatic devices, processes, or methods to access the Games and retrieve, index, and/or mine data information.

Attempt to access the Games through any service or platform not authorized by DATA PROS, LLC.

Attempt to interfere with, hack into, or decipher any transmissions to or from the Game servers; or interfere with the enjoyment of the Games by others, including disrupting, overloading, or assisting in disrupting or overloading the Game servers.

Intellectual Property

The Games and any services and/or content therein, as well as the Company's proprietary assets and any and all intellectual property rights related thereto, including but not limited to inventions, patents and patent applications, trademarks, trade names, copyrighted material, graphics, sounds, animations, text, images, designs, specifications, methods, programs, information, know-how, algorithms, data, technical data, interactive features, source and object code, files, interfaces, trade secrets, whether registered or registrable or not, are owned by and/or licensed to the Company and are protected by applicable copyright laws and other intellectual property laws and international conventions. Notwithstanding anything else in this Agreement, you agree that the Games under this Agreement are licensed, not sold. All rights not expressly granted to you in this Agreement are reserved by the Company and its licensors.

Minors:

You must be at least thirteen (13) years old to play our Games.

If you are under thirteen (13) years old, please do not use our Games.

We reserve the right to request proof of age at any stage. We may block users we suspect are under thirteen (13) years old. We will make every effort to promptly delete any personal information (as defined in our Privacy Policy) associated with such users.
